What is the name of your state? CA

Can you request to see your own complete employment file. My brother was recently discharged from a job of 18 years and has had trouble getting a job after 3 months at the point where they verify past employment, and speak to the last employer. I thought, perhaps, he could request to take a peak at what might be told to future employers when they call. Can he do this?

CA statutes on the matter state that employees are allowed to inspect all documents related to their qualifications for employment, promotion, additional compensation, termination, or discipline. Employees are not permitted access to records relating to the investigation of a possible criminal offense, or to letters of reference.

And while you didn't ask this question, your brother's employer is free to provide any information they wish to to prospective employers provided it is factually truthful and represents their honest opinion. If your brother was discharged for some form of misconduct, his former employer is free to share that when contacted for a reference.
