I was offered the opportunity to either resign or be terminated and prosecuted. I had to make the decision on the spot or be immediately terminated and prosecuted. I was a Certified Nurse's Assistant at a Nursing Home. One of my duties was to do whatever the nurse told me to do. I signed the nurse's initials to her checklist per her request. This was reported to the director and that is what the director used to threaten me with prosecution if I didn't immediately resign. In fear of being prosecuted I resigned. I have 2 questions:
1. Could I have been prosecuted for fraud?
2. Should I now hire a lawyer and sue?

1. Maybe so, maybe not. But you could lose your license.
2. Sue for what? You were not wrongfully terminated under the law.

You MIGHT qualify for unemployment benefits, but there is no guarantee. File and find out.
