What is the name of your state (only U.S. law)? south carolina. if my employer "phases out" my dept and only provides option of demotion or quitting, do i have a chance to force them to offer a severance? i know SC is an at will state, however my employer has offered my dept a severance package on two prior downsizings. in additions, other employees having the same job level and salary band are currently offered severance. is it possible that this is discrimination considering my department is 95% AFRICAN AMERICAN and 100% FEMALE?

Yes indeedy! Some employers in South Carolina do have severance policies!

Whether any of these policies are enforceable is a whole 'nother story, though. It really depends on the individual, and his/her personal story.

And even if they DO have a policy, whether or not it rises to the level of an enforceable contractual obligation is in the details. Only an attorney in your state who has read such a policy in its entirety can tell you.

What does the makeup of the department have to do with anything?
