I am currently an employee for a company that has a government contract on a military base in Maryland. This position is employment at will and I am an hourly rate employee. This company is now trying to require us to hold stand by. They issue a beeper and require that person to respond (report to work) within one hour. We are not paid durning the time we hold the beeper, we are only paid from the time we report to work until we are released. Holding standby was not a stipulation of the employment and was not started until after a few months of employment. Can they force us to respond to their beeper if we are not on the clock? Can we be fired for not showing up or showing up after their one hour rule? From what we can tell the fair labor law says we must be paid while preforming standby (holding a beeper) is this true?
