What is the name of your state? WA

My husband has been working for one company for two years, serving as the Web and Media Coordinator for two. This company did not have a marketing department and kept making comments that once the department was in place, he would eventually move into it with this title and position. The new department was formed about six months ago with a new boss. About three weeks ago, this new boss decided to interview internal applicants for the position and informed my husband that if he wanted the position, he would have to interview for it. Well, today he found out that another person got his job. They do not have a new position to relocate him to, they have not fired him (and they wouldn't have reason to), they did not post the job internally or externally (just word of mouth). Is that legal? To just decide to take someone's job away?
