I have a long-time friend who has worked in a prominent, well-known school district in a midwestern city as a history teacher and English teacher. Due to her past interest in music, marching bands, and the similar sort, she decided to take another job in the same district, helping out with one of the high school marching bands. My friend's new job as a Color Guard (Flag) instructor made her mostly active in the Band department at her school, but the athletics department director was her official boss. He was never cooperative to say the least: for example, he told her that he would pay for a bus to a competition, but he later sent her the bill months afterward. (This sort of thing happened multiple times.) Also, he repeatedly denied her access to gymnasiums or practice facilities, and then he would very crudely criticize her publicly and privately for seeking other facilities. As a final example, he told her that her Color Guard squad was not allowed to participate in some of the school spirit assemblies, although all other groups were welcomed. In April 2005, he finally fired her after many such incidents without giving her any reason! He told her she could re-apply for her position, which she did, but he instead hired someone with absolutely no experience whatsoever in the area of Color Guard, music, or band...

My bottom-line question is this: what rights does she have? Can she recover the money she had to shell out after her boss told her that HE would pay? Does she have any grounds to claim that she was wrongfully terminated? She IS in the local and national teacher's union, if that's of any help.

This was not a wrongful termination; she was not fired for an illegal reason. Her recourse is to file a grievance with her union and/or appeal the Athletics Department Director's decision to terminate her to the appropropriate school administrator or the school board.
