My wife and I work for the same newspaper and we were both recently fired for investigating the possibility of starting our own newspaper in the same community in Illinois. We do have non-compete provisions in our contract. We did not do ANY researching of the proposed new paper on our former employer's time. Although I think the no-compete provision can be broken, at least on my wife's side, I have another issue.
In doing our research we contacted a printer in the region for rates on printing our new product. The printer was advertising for print jobs on their Web site and that is where we responded to the solicitation. My wife included in the email message that the request had to remain confidential. However, the publisher or new business director at that facility forwarded the email to our boss, who then fired us.
We think we have possible legal recourses against both.
