California.

Can an employee after 3 years in a position be terminated on the basis of a bad credit history as a result of a-Post background check? It seems that the whole purpose of a background check is to eliminate hiring anyone that would compromise the safety or productivity of a company. And the 3 years of employment should reflect the trustworthiness and/or competence of the employee irregardless of their financial situation.

Yes, an employee can legally be fired for a poor credit history, even three years after the fact. I'm not saying I agree with doing so - unless it is substantially related to the job itself, I don't. But it is legal.
