Termination for performance

What is the name of your state (only U.S. law)? Florida

Employee was terminated due to poor performance, there were no written warnings regarding the performance, his supervisor had verbally advised him numerous times before. His a driver, he spends 25% of his time delivering or picking up merchandise and 75% is spent in the warehouse pulling orders. Average day worked 8.52 hours: 3.5 hrs were spent out delivering/picking up, 1.12 hours spent pulling (29 boxes) orders, .30 minute lunch, 15 min. break; total of 3 hours and 45 minutes unaccounted for. Would the company have issues with this termination?What is the name of your state (only U.S. law)?

The first issue that comes to mind is the fact that the company probably needs to hire another driver.

Did you have other types of issues in mind?

In other words, he had a little over 3 hours of his time unaccounted for during the day? I'm not following. What exactly is the question? Can the company fire him. Yes.

And can he file a grievance, sue somebody, lodge a complaint about his firning? It isn't sounding like he'd have much of a case anywhere, as they can fire you for lots of reasons, as long as they don't violate any of the formal statutes.

He should file for unemployment insurance. It will be determined by them whether he was discharged for poor performance that amounted to misconduct or not.

Apparently he feels that he has a case, he is requesting copies of his attendance records for the past 2 years, termination form stating reason for his termination and a letter of recommendation for future use. Thank you
