What is the name of your state? NY

Are there certain rules or regulation in regards to terminating an employee?

When firing someone, does it have to be done in a particular method?

example: can it be done by telephone?; does the employee have to sign anything? if done in person, should there be a witness?

NY is an at-will state, but to avoid any future problems, such as unemployment eligibility and such.

Yes. the termination cannot violate the law, i.e. it cannot be BECAUSE the employee is a member of a group protected by law and it cannot be BECAUSE the employee requested or utilized a right or benefit protected by law.

There are no laws in any state that dictate how an employee must be fired. It can be done in person, by telephone, by letter, by e-mail, by fax, by Western Union, by singing telegram, by carrier pigeon, or by smoke signal. There is nothing that the law requires an employee to sign. Whether or not there should be a witness depends on company policy and the specific situation.
