My Brother-in-law worked for a big pharma company, henceforth Company A, who recently outsourced their sales to a competitor, Company B. In September, company A's sales reps were told that they would all be effectively laid off at year end. Company B would offer some of them jobs. If they were not offered a job, they would receive severance of 2 weeks per year of service. If they were offered a job they would get no severance whether they accepted the new job or not. If they left befor 12/31 they would forfeit their year end bonus. In short, he was forced to accept the new position that was offered although he didn't want it, in order to receive the bonus he was entitled to. My question is, since he was terminated from the previous company, and the severance policy has always been well known, isn't he entitled to his 14 weeks severance, and bonus beacuse he was released effective December 31 from Comapany A?

No. (a) An employer is never obligated to provide severance. (b) The terms of severance were made clear and the terms outlined are quite common for employers who opt to offer severance under these circumstances - an employee who is offered other work is not eligible for severance.
