california: our design staff of 3 was informed that the company could no longer provide us with salaries beginning may 1. this had nothing to do with our performance. we were then offered contractual employment at a lower than average freelance rate on a per project basis with no guarantee of incoming work. i chose not to accept the new terms of employment and left on april 30. one other employee did the same and the other decided to stay on contractually. i was informed that the one that stayed on was given his salary back. i have filed a claim with unemployment and have an interview next week. i am a bit confused as to what my rights are and feel that something is definitely not right with this situation. my former employer continues to call and is requesting a letter of resignation. i will not provide anything to him until i discuss the issue with unemployment. is this an instance constructive wrongful termination?
