What is the name of your state (only U.S. law)? Kentucky

I have a very strange situation. First of all, a little background. I took yesterday off for a long weekend trip with my daughter, so today was my first day at work this week.

Friday, after I got home from work, I posted on Facebook "TGIF! A fun weekend ahead!!!" This was posted at 6 PM, well after I had gotten home. I went into work today to find all my computer access denied. I went to my manager and he said "Why are you here? I was told you don't work here anymore." I had even said "See you Tuesday" to him on my way out Friday. I went to HR and the HR manager told me that I had quit my job on Friday without giving notice! I told her she had been mistaken, I NEVER quit my job. She said that I had posted TGIF on Facebook, and that proved that I had indeed quit. I said "what?" She proceeded to tell me that TGIF stands for "Thank God I'm Finished" and that meant that I quit. She said is was further confirmed when I did not show up Monday (yesterday). I told her yesterday was a pre-approved vacation day that had been approved over a month ago. She said, I already processed your "final paperwork", and to get out. I went back to my desk and sat for a few minutes, floored. I decided I would remain at my desk so they couldn't say I "walked out". 20 minutes later, she comes into my office, tells me again that I had quit without notice, and then had security escort me from the building!!!

I am so confused right now. Do I have any legal way of getting my job "back"? Is there anything I can do about this????

unless you have a contract or a collective bargaining agreement, you have no legal recourse. They can terminate your employment at will with no reason.

appeal to any superior in the company you know.

File for unemployment. Apparently, they were not thrilled about you skipping work, to play, without using an authorized day off.

the day was pre-scheduled and pre-approved.

Something about this sounds terribly odd.

Everybody knows TGIF means tongue goes in first... I mean thank God it's Friday.

But even if they truly thought it referred to "Thank God I'm Finished", how do they know it wasn't referring to the project OP was working on and it meant they finally finished it so now they could enjoy their vacation day without thinking about the project the entire time.

I suspect employer was looking for a reason to get rid of OP. Nothing else really makes any sense.

Your boss is certifiably insane, but no law says terminations must make sense. File for unemployment and NEVER friend your boss on Facebook!

OH, learn to read.

LOL, I thought she said she took Friday off also. My spouse was interrupting me when I was reading.

My manager was surprised as well. He said HR came up to him Monday morning and said I quit without notice. I'm not facebook friends with anyone at the office so I don't know how they even saw it!

I have a great rapport with everyone in the office and my evaluations over the years always rate me as "exceptionally effective".

I have no idea what us up with the woman in HR. She started with the company about 3 weeks ago. All of the "I quit" stuff came from her, mot management. I've only ever said "good morning" to this woman.

then I suggest you call "management" and discuss the situation. Don't disparage HR, even if you believe it is deserved. If you actually have value to the company, the smart thing would be to bring you back on.

There is no law you can invoke that will force the employer to give you your job back. In the absence of a legally binding and enforceable contract or CBA that expressly says otherwise, if the employer wants you gone, you're gone.

That being said, there is no downside to contacting your manager/HR/upper management, whichever is appropriate, and seeing if you can work something out with them.

If all else fails, apply for unemployment. And do that sooner rather than later.

You need to understand that you have no rights here. File for unemployment immediately in case you don't get the job back.

Once you've got your unemployment claim filed spend the rest of your time appealing to the top ranks of your company about the "horrible mix-up" that occurred and plead for them to intervene with HR and restore your job.

This whole thing makes no sense. We are missing a piece of the story whether intentional or unintentional on the part of the OP. No company cares about its experience rating with UE so much as to monitor an office worker's facebook and find a way to turn a vacation into a voluntary quit. Remember, this is an employee with a private office at the company. There is more here than we're being told.

Additional Information

Here is some additional information. This is an IT company, so we're all pretty much computer "geeks" here. When the new HR manager took over, we had a company meeting. She isis the niece of thethe owner's wife. At that time all administrative titles were changed. I went from Director of Informatics to Manager of Informatics and so on. My "manager" is the Manager of Operations, he used to be called the Senior VP of Operations. The new HR manager said the new titles gave the company a more "family" feel.

Two weeks ago, one of the administrative assistants was fired fir something she had posted on Facebook. She had "friended" several people at the office, so I figured that's how admin saw her posts. I'm not so sure now. Something's amiss here. I'm going to call my "manager" this morning.

Sounds like this HR person is not an HR professional but rather someone's niece pretending to be an HR professional. Happens all the time, especially in IT companies where there is little to no understanding of HR as a profession and where someone making asinine comments about how changing position titles gives the company a "family feel" is taken seriously. Been there, more than once. :(
