my name is starla muraszka i live in new york state. i january 2000 i quit my job because of too many hours (was working upwards of 60 hours a week and my employer was not granting me relief dispite numerous requests), and workplace conditions which were very arguous. i was initially denied benefits but granted a hearing. i won the initial hearing and recieved a full compliment of benefits. my case was appealed, a new hearing was granted, my employer perjured herself regarding workplace issues, had a witness testify untruthfully as well and the finding was reversed. i appealed to the hearing board in new york state and they determined that perjury was not an adequete reason to overturn the case. i must now appeal to the appellate division of the supreme court on questions of the law only.
can you tell me what matters of employment law (and perjury for that matter) on which i can appeal?

Well NOW YOU KNOW........

NEVER QUIT A JOB IN AMERICA......and expect to collect unemployment without a big fight!

It is a strange part of our system of government, Unemployment is NOT a legal court of law. So you could have said your boss was a lesbian and thats why you quit, she made passes at you, and nothing can happen because Unemployment is an Admistrative hearing and anything said in there is Protected speech, that means protected from lawsuits!

Now you lost on your appeal, the next step is a REAL court of law in which if you said she was lesbian you would have to PROVE IT! So now you have to PROVE under OATH the perjury.

The boss and the witness can lie but if you have proof of their lying then you cross examine their testimony, under oath in a court of law, if you cant get any proof from other witneses, or memos etc, then you are probably outta luck.

Now why on earth were you working 60 hours a week? were you making $100K?

It would have been much better for you to document the hours and be fired, then to quit.

I have been escorted out of buildings by Armed Guards and still collected Unemployment because I never QUIT! go ahead make my day..throw my assss out!

Somehow the fact that you've been escorted off various employers premesis by armed guards on more than one occasion comes as no surprise. But hey, as long as you collected your UC benefits...

I learned MY lesson at 20 when i quit my job for almost the same reason, they forced us into overtime by saying we had to finish our quota before we left, the company was pushing up the timetable for the job so the buyer would not cancel the remaning orders...

and i had been going to night college PT and my grades were suffering

So NEVER QUIT A JOB IN AMERICA.....unless the boss is chasing you around with his pecker in his hand!
