In any case, if you are found ineligible for benefits you will almost certainly have to pay back all the UC benefits you have received.

What's more, based on the facts as you have presented them, I wouldn't be at all surprised if your former employer won the appeal. It depends on state law, so I could be wrong, but in my state you'd be on very shaky ground.
