My husband received a DUI on June 30, 2000. License was suspended. He was a truck driver. He informed employer of DUI. Between 6/30 - 9/5 husband had been hospitalized. Applied for unemployment 9/5. Denied "any ordinary person would not have quit employment". He technically did not quit his job was pending his hearing. Hearing held 12/19. Employer had told him that his job would be held until a dtermination was made. If convicted employer could not insure him. Appeal held in front of "review Commisioner" 1/19/01. Decision today "outcome of conviction would had been sufficient for employer to discharge employee". Appeal denied. There are also medical issues here but that is a whole different story. Would my husband be entitled to unemployment? Or are we wasting our time appealing all of these denials
