Here is my story and response. Any comments??? I worked as a civilian contractor at an Air Force Base, and I myself am retired AF.
I was fired from my job due to the following: (names were changed to protect the innocent) This letter is a response after I have been fired.

You should also know that this is the first and only time I have been made aware of the allegations against me, and therefore the first time I have been given an opportunity to defend myself.

My rights were violated during the first interview conducted by Lt. Col X (JAG Officer), on 28 Jan 2004. Upon start of interview, I was explicitly told that I was not a suspect at all of any violation or incident, but only a witness and I was asked to help in an investigation, whereas had I know I was a suspect I would have asked for representation. I felt uncomfortable and intimidated. I also felt uncomfortable when asked by the JAG officer to obtain copies of another contractor’s contracts; XYZ Ltd. in order to determine government rights on ownership of the contractor’s computer. As a contractor I was not allowed the opportunity to have my supervisor present at the interview. Upon the start of the second interview to sign my statement; again, I was told I was just a witness and was just helping in an investigation and asked further questions; and asked to provide an additional statement, in which I did.

False allegation of sexual harassment by Ms. Jane Doe. The only time I worked or was in contact with Ms. Jane Doe was for a two - three month period in 1999, while I was employed with a different contractor; i.e. ABC Technology, Inc. Ms. Doe worked with me as a part-time assistant in the Laboratory. Her husband also did job orders for me at the same time. Neither she, nor he ever complained to me or my supervisor about any inappropriate, comments or actions that offended her. No complaints were ever made to ABC Technology, Inc during that time in 1999. Nor were any allegations of sexual harassment complaints filed against me during my time with ABC during the time period I was employed by them from Jul 1995 through April 2000. No complaints were ever made to the Air Force during that timeframe I was in contact with Ms. Doe. My position is that this charge is totally false; questionable in it timeliness of five years after the supposed comment/allegation took place

False allegation of sexual harassment by Ms. Nobody. At no time has Ms. Nobody ever complain to me or my supervisor; Ms. Mya Boss ABC Technology, Inc; her Supervisor, Mr. CEO of XYZ Ltd, nor the Air Force; Dr. Scientist of any comments that I made to her that made her felt uncomfortable or harassed on any occasion. This can be confirmed by contacting these companies as I did. She herself has, on numerous occasions during my employment at the lab, come into my office and to tell me of her sexual encounters and experiences with various members of the Laboratory. During these unsolicitated conversations with Ms. Nobody, even though I was shocked and dismayed at someone of her age and supposed maturity level would venture into that type of activity, I never imagined that she would construe my comments “in response” as harassment. Myself and other members of the Laboratory have heard her speak of her sexual encounters and experiences with other members of the Laboratory in an open forum type atmosphere on numerous occasions. Specifically “Names listed”

False allegation of sexual harassment by Ms. Teen Studentaid. In response to allegation of sexual harassment and attempting to touch her abdomen beneath her shirt. In Mar 2003, when Ms Teen Studentaid starting working at the lab, I approached her and did criticize her for her attire. Pointing to her belly I stated I thought her mid-drift shirt and baggy pants was an outfit that was inappropriate for a business office and thought she needed to start wearing more business-like clothing. That when I was in the Air Force it was demanded to always present a professional appearance. At the time Dr. Scientist counseled me that Ms. Teen Studentaid took offense to my comments and that I was not to comment anymore about her attire. I apologized to Ms. Teen Studentaid at that time. Dr. Scientist told me that he had to elevate it up to his supervisor as per his responsibilities. No further action was taken at that time.

My position is that this charge is totally false and my intentions at that time were totally innocent and not of a sexual nature. Only meant to teach her to try and maintain some sort of Air Force standard of professional appearances at our office. Questionable in it timeliness of a year after the comment/gesture took place. Ms. Teen Studentaid and I did not have a good working relationship during my employment at the Lab, as I feel she begrudged me for continuously complaining to Dr. Scientist and Boss’es Assistant about her not doing her assigned work, leaving the office for long periods of time, and doing school work during work hours. Eventually Dr. Scientist had me start writing her work assignments on my white board and check status of the progress through Ms. Boss’es Assistant. I do admit that I did make comments about Ms. Teen Studentaid and Lt Just JoinAF in regards to an incident I observed while on a smoke break outside bldg between them in the parking lot of the Laboratory that occurred in Sept 2003. I am not now trying to minimize those comments, however; I was angry and upset with her and the Lieutenant spending two hours in the parking lot, where I was forced to do her job and answer phones. I did mention to other employees that they should be doing their work and save that kind of activity for home. I did not report the incident, as I did not wish for the Lieutenant to get into trouble. I can only explain as to the reason of not reporting the incident as of some sort of loyalty to an Air Force member (me being a retired Air Force member) and a young couple being in what I assumed to be love.

Finally, the accusation that I violated Air Force policy by using the Air Force computer network to repeatedly view internet pornography in the workplace, during duty hours is completely and utterly false in its entirety! Totally disgusting and slander in it’s own right period. During the timeframe, it is a fact that anytime a pornography website popped up through an email, I followed Air Force policy to the letter and reported it the occurrence to my Air Force supervisor, Dr. Scientist, and in turn he instructed me to go over to the IT office and see what they could do. All they stated was that they were aware of the problem and was trying to work on filters to stop this type of email. That somehow my Air Force email address was obtained by these websites and every time I would follow the steps in the email to tell the website to remove my address, all I was really doing was confirming that the address was a correct. At one point an “IT Tech” named Sam Software came to my office to put software on my computer and again I complained to him about the pornographic email. He again stated they were aware of the problem and was trying to put a firewall up to prevent such occurrences. It seems to me that this can be verified. It is also logical to find out with today’s technology, that the time amount spent on these websites, by my computer were seconds, not minutes, as I would click them off as soon as they would appear. As stated factually earlier, I reported these incidents as per Air Force policy, and yet, with this faulty investigation, this little fact was not investigated. I fully admit I did received personal email from friends and family members, which were not of an official Air Force business nature. I fully admit I went onto non official websites, like NBC, ABC, CNN, and Fox News websites, Ebay, and others, however, I deny categorically that I ever purposely went into pornographic websites. It seems to me, from what I understand of the timeframe that was investigated, i.e., as far back as 9 months; that only 51 occurrences of pornographic websites was discovered out of 170 plus working days. Surely this would provide some sort of proof that these were unsolicited email pop-ups. Wouldn’t it seem like there would be more if I was some sort of website pornographic pervert?

I retired from the United States Air Force with an exemplarily record; I worked for over nine years at the lab with the same type of record, Exemplarily! I find it totally devastating and disheartening that I served my country with honor and loyality, served and protected this great nation for the rights of the American people, other armed forces members are currently dying in Iraq to provide that same protection of rights and yet I did not earn the right of due process and fair and equal investigation.
