I was employed @ a union plant with a union contract after i was elected grievance person for the union and filed many grievances against the company the employer made life @ work hard for me by harrasing me in many ways as if they wanted me to quit , I didnt quit so the plant mgr along with the union offered me an ultimatum accept a layoff or be harrased until i Would quit or be fired.I foolishly agreed . A 3 step thing was offered i would get my layoff, when the unemployment office sent the employer the yellow form about my unemployment they would just not return it in the 10 day period ,automatically allowing me to collect, and i HAD to sign a notice to quit form. Now i am getting no unemployment he's saying i quit. Can I now can sue both for damages the union for misrepresentation and the company for bargaining outside of the contract

Don't waste any money on an attorney yet.

Contact your nearest Regional Office of the National Labor Relations Board and talk to the information officer about filing an unfair labor practice charge against the Union for misrepresentation, not performing their fiduciary duties and/or collusion with the employer and against the Company for retaliatory harassment for performing your legitimate union duties as a shop steward.
