What is the name of your state? North Carolina I worked for Company 11 months and was laid off. I could get my first ONE WEEK vacation after 12 months. When I asked employer I get answer that I could not get vacation (accrued) pay because I did not work 12 months. Can I require Company to pay out these 4 vacation days?

Senior Member
No company is required to offer paid vacation. For those that do, some accrue it monthly, some annually. If your employer's policy states that vacation is earned through the completion of full years of service, then no, they do not have to pay out any vacation if you did not work a full 12 months.
