violation of FCRA?

My husband had an offer of employment withdrawn and in the decline letter, the company stated it was "due to information obtained" in their background checks.
We know for a fact that they use 3rd party agencies for their background checks.
Despite repeated written and oral requests citing FCRA, he got no response from the company other than to be told that the FCRA only applied to credit information and not other background info and that he should check his references.
Well, the references he used were ones he had used before and it is our understanding of the law that FCRA includes any background info obtained and also gives the consumer the right to dispute any findings. This company never gave him this opportunity.
Are they wrong and liable? The difference in the salary he would have made there and what he is making is double.
