Virginia Non-Compete/Disclosure

I have been employeed with my current employer for 1 1/2 years now. Circumstances involving other High level executives has made the owners decide that a Non-Compete/Non-Disclosure agreement is necessary. I have read in a few places that because it was not presented to me before I was employeed with the company that it cannot in fact be enforced. Is this true?

If so can someone point me to some good places to get some information on this?
