What is the name of your state? Massachusetts

Several candidates applied for a higher level position that opened up in a company. Several candidates were qualified. The person who received the position is not a U.S. resident. They are here from Canada working, but they do not have a green card. I thought that if there was a qualified US resident that they should be given preference. Are there any laws in reference to this? Thanks.

Are there any laws in reference to this? Yes, and they specifically make it unlawful to discriminate on the basis of national origin. In other words, the law dicates exactly the opposite of what you are suggesting. The best qualified candidate (as determined by management) gets the job regardless of gender, race, color, creed, national origin, handicap, pregnancy, age, and so on.
