What is the name of your state? Mississippi
Most employers today require you to sign a waiver stating you will not hold prior employers liable for anything they might say about you. Just how legal and binding are these "contracts."

It depends on both the state and the exact wording of the contract, not to mention exactly what they say.

And in most States these days, that's an irrelevant document anyway. Most States legislatures have passed "hold harmless" reference laws which bar an employer from any civil liability if they provide a reference "in good faith."
