I was injured on the job and the company sent me to a doctor when I arrived I was informed that the company nurse had told the Dr. office to charge my personal insurance and not W/C. I did so against my better judgement. When I asked the co. nurse why she did this she said that was not true but that the Dr. must have decided that this was not a work related injury. First of all when the Dr.'s nurse informed me of this I hadn't seen the Dr. yet and all he did was ask me some questions and ordered some test and told me he would contact me if my test were positive. Since then I have seen a Dr. of my choice a specialist in orthipedics who has been treating me with phy.therapy and medication. The extent of my injury is unknown at this time. Since my injury I found out the company has yet to file a first report of injury, notify W/C or file an OSHA report on my injury futher more my insurance has payed for everything except my co-pay. The saftey steward made an accident report and this was reported to my supervisor when I was injured. I work in Tn. and live in Va.
What do I need to do and do I have a case?
