We worked for a leasing company, that leased drivers to Calgon corp.We
were Teamsters and had a contract with the leasing company.The leasing
company had a contract with Calgon that we were not privy to.Calgon was
bought by a french company that in turn bought Nalco which was a
competor to Calgon.Nalco merged the companys together and we continued
to drive for Nalco and they paid our leasing company to pay us under
whatever their contract was.Nalco had drivers at other locations that
worked directly for nalco and were not union.We had over a year
remaining on our contract with the leasing company, Nalco started to
take loads away from our location and put on other plants reducing the
loads caused 5 drivers to quit over a period of time, due to decrease in
the miles and pay. Nalco didnot want union drivers and that was conveyed
to us more then once.There was only three of us left when the leasing
company stock holders voted to close the company because of workers comp
coverage we were told. The leasing company offered Nalco the oppurinty
to switch us over to another leasing company and we could continue to
drive for them.Nalco said this was their chance to get away from the
contract and union drivers.Under our contract all monies owed were to be
paid when we were laid off. Nalco refused to pay the leasing company to
pay us vacation pay that we had coming under contract.We filed
greivances under our contract for the pay which took 5 months to finally
go thru the panel. Our greivance was upheld but the leasing company is
closed and there no contact with them all phones disconected.The union
says thats all they can do, they cant do any thing to Nalco since their
name was not in contract..This is over about aprox 14,000 dollars for
our wages. What rights do we now have under the law. Where do we go from
here?
