What is the name of your state? Kentucky My 21 year old daughter interviewed for a job with a prospective employer who was rude, hateful and insulting. Afterwards she told him that she wanted her application back as she did not want him having her personal information. He told her that it is now his personal property and that she would have to get a lawyer to get it back and threatened to call the police. Is he right or can she get her application back?

He is right. The application form is the property of the employer.

I strongly suggest your daughter just walk away from this. Absent a court order (and that's not going to happen), the employer doesn't have to turn it over to her and the situation is just not worth any further hassle.
