What is the name of your state? My state is New York.

I wrote earlier about my daughter's boss withholding pay from here (see end of message for first post). Here is my next question or questions I should say. Is it harassment if my daughter calls her boss once a day for several days requesting her pay? Her boss seems to think so and says if she calls once more he will file harassment charges. He seems to forget HE was the one who threatened to "hunt her down" if she told his wife anything about their dispute of her leaving the job. And it was HIS WIFE who called her cellphone and left her a voicemail that ended with "You whiney little B****." This voicemail was recorded and saved. So is it illegal or considered harassment for her to call once a day requesting pay? And my second question is should she send a letter to the editor of her newspaper about her experience with his emoployer and the fact that he withholds wages from his employees? She has already contacted the Labor Board and Attorney General to file claims against them, but with all this trouble he has put a 20 year old college student through, she wants to get him on every legal angle possible. Can you blame her?

My state is New York My daughter is a 20 year old college student. she was working at a deli. she quit on wed. after being forced and friday was payday. she left my address and they were to mail her her money. after a week went by and another payday I called about her check and was told she wouldnt get her money till she paid 20.00 for a peice of glass from a frame that fell of the wall while she happened to be working. she wasnt the one who took on the responsiblity of those paintings when they were put on display in his deli he did. so as more time went on and no pay I called him again(about two weeks) he told me he decided to go ahead and pay her cause it was the right thing to do and to be looking in the mail for it. huh.......its been 3 1/2 weeks now and still nothing. she called him one time today.. he yelled ..your not getting it till I get my 20 bucks and dont call here again or I will slap harasssment charges on ya and hung up. Is this guy right or what can he do all this withholding over 20.00 she never should pay anyways. She didnt even work there when they were placed in the deli. and her point is how can I pay him if I cant get paid, not that she should pay him. were talking about 43 hours at over 7 an hour. to her thats alot of money.

"Is it harassment if my daughter calls her boss once a day for several days requesting her pay?" No, it's not harassment but obviously it's annoying the boss. Not that we should CARE that the boss is getting annoyed under the circumstances. The pertinent point however is that IT'S NOT WORKING.

"So is it illegal or considered harassment for her to call once a day requesting pay?" Yes, it's legal but it's dumb.

That would also be dumb. Plus nobody would care. Nonetheless, your daughter can send a letter for the OpEd page if she wants to. Whether it will be printed is anybody's guess.

Your daughter should quit wasting her time calling the employer or writing letters and let the Labor Board do it's job. They can cause the employer more pain than your daughter can - fines, audits, etc.
