What is the name of your state? New Jersey

can an employer withhold your last check to pay for an accident you had with the company vehicle, on company time? if you were told at the time of the accident not to worry about it, and they said nothing of paying it back until the day after they laid you off, can they do that?

There are NO circumstances in any state where your entire paycheck can be withheld. At a minimum, you must receive minimum wage for the number of hours your worked in the final pay period.

As far as my resources go, New Jersey law is silent as to the legality of deductions for shortages and breakages. There is a law restricting deductions that can be taken, but breakages is not mentioned specifically either pro or con. You are free to contact the NJ DOL to ask them the current status of such deductions.
