Work for School District. Clearing out the exhaust pipes on the slanted roof of school, slipped and caused a herniated disk. From January 2000 til May went to Chiropractor regularly and was sent to two other doctors that stuck needles in muscles in neck & arm & back to establish extent of PermanantPartial Impairment (PPI) benefits. Went to an unbiased doctor who established dissability of 15%.

The Workmans Comp Adjuster sent us a check of 20,000. Based on percentage of the bodies total worth of 135,000. Day we received check, got a call from Workmans Comp saying they were putting a stop payment on check since now we were going in for surgery (fusing disk in neck). Have recovered completely from surgery with no aftereffects. Went great! But........

Doctor says they are required to pay the PPI benefit because........ had the surgery provided the same or more
dissability, the percentage would NOT have changed. The PPI is a separate thing from being able to fix the problem. He consulted the 2 other doctors and they also agreed with our first doctor. Now our dr. is saying we need to take this to court. Is there a chance of this going our way, or is this way off base?

Husband is back to work after being off 5 months with WC pay. All bills were paid, its just a matter of this
PPI and where we stand legally. Can you help?
