    Wrongful ?

    What is the name of your state? Massachusetts
    undefined I cannot figure this out. My husband had worked within a company for 5 years. A small company with 4 employees at one location. Company just gave out raises, company profit sharing etc. for all. Company meeting in November showed huge profits. Now comes January 2005 - out of no where, he is called up to the main building by the location manager and someone from the main office. He is laid off for
    " company cutbacks" financially the company had to make a cut they say. Shocked we most definately were. Now we find out that the company hired the brother of another co-worker. This just seems unreal, can a company actually get away with this? There has got to be something we can do.

    Yes, they can legally do this and no, there is nothing you can do.

    It is not illegal to lie about the reason an employee is being terminated. It is not illegal to terminate the employment of one person in order to hire another.

    Unless your husband has a VALID reason to believe that he was terminated not in order to hire the co-workers brother, but BECAUSE OF his race, religion national origin etc., or BECAUSE he applied for or utilized a benefit or right that is protected under the law, then this may very well be unfair but it does not qualify as a wrongful termination under the law and you do not have any legal recourse.
