Wrongful Termination

I was hired by a state agency in a position which had a 1 year probation period. After 1 year, agency was supposed to follow State agency termination procedures. I began duties in this position on 3/26/06.

I was given no indication that my performance was not satisfactory until I had been in job almost 11 months. Then I was called in and "raked over the coals" for ridiculous infractions that occurred when I first began job. Most recent infraction was 6 months ago.

I was then called in on 3/26/07 and told I was fired for "failure to improve performance." This was 1 yr. and 1 day after I began duties--in other words, more than 1 year after beginning duties.

Since firing occurred more than 1 year after beginning duties and agency did not follow State Government Employee procedures for termination of a government employee, would this be considered "wrongful termination"?

3/26/06 is exactly a year from 3/26/07. Sorry, but this is not wrongfull termination.

Wrongful termination means that an individual was terminated for a reason specifically prohibited by law. That is not your situation. If you think the decision was unfair or in violation of your agency's policies, you may avail yourself of whatever internal appeals process the agency has (if any) but nothing illegal transpired.
