What is the name of your state (NY)?

I was wrongful termination for getting a rain check on my job I started to
get unemployment and then my job told unemployment I was fired for breaking
company policy
and was denied benefits so i appealed and won where the judge even said i
never Brock company policy this all started on 5 /31/09
i was with a union and my delegate even said there was no reason for me for
getting fired and felt there was more to it .
i asked for arbitration and was told that there would have to set a meeting up
nothing was done till this day i even called my delegate back to find out if i
can get my job back he now tell's me there's nothing he can do and that i
should go get a lawyer ? to you is do you think i have a case to sue i was
a butcher working at shop rite making $21 a hour i even tried to look for work
i found a few
and thought i had found a few after talking to the person at the job interview
they would tell me all then need to do is a job back ground check i would never
here from them again . feel i been black listed now

Your written command of the English language is so poor I am not sure I understood what happened. However, it takes far, far more than being awarded unemployment benefits to have a wrongful termination claim - the vast majority of people collecting unemployment were legally terminated. Before you can sue for a wrongful term, there must be a specific law that the employer violated by terming you. What law do you think would otherwise have prevented your termination? Please try to make your response more understandable than your initial post.

I worked for Shop rite supermarket as a butcher i was fired for receving a rain check they said it was breaking company policy it was not .
I was in the union that has a contract with the supermarket
the union failed to do anything and i feel i was fired becuase the menger
just didn't like me

If we cannot understand what you are saying, there is no way for us to help.

The law does NOT prohibit your employer from firing you because they believe you violated a company policy, even if they are wrong and you can prove it. This was not a wrongful termination as defined by law, and you have no grounds under the law to sue.

IF this was a violation of your CBA, then you may have recourse through your union, but you would have to discuss this with them.

Dabutcher, I am glad you got your unemployment approved. I honestly believe this is as good as it will get. It doesn't sound like your union is going to do much about getting your job back for you, and besides, do you really want to go back to working for these people anyhow? They could find another reason to fire you again quickly anyhow.

Please put your head down, concentrate on getting another job, anyplace, anywhere. Because the times are tough, there are not a lot of good jobs out there, and there is not, in my opinion a good enough reason to hire an attorney here and try to get your old job back.

You might be getting a bad recommendation from the former employer, but that's not going to change. You don't have a good enough case to carry this out, it will take a long time, and you will not gain enough to make it worth your time. I hope you can find another job soon, but please don't waste a lot of time wanting things to go back to being as they used to be, when it won't happen.
