Wrongful Termination vs. At Will Employment?

Happy to share more details based on your questions. Here's my story.

Worked for company since August 2000. Had a fantastic review (as always) in late August. Dismissed without any warning last Monday for violation of company internet usage policy. When shown copies of this supposed inappropriate usage, the majority of what I was shown was not my usage (as a married Christian I don't have a desire for pornography or a need for dating sites). Further, I have recently been the victim of credit card/identity fraud. I was not permitted to take the time to review these documents that supposedly documented my inappropriate surfing behavior. While I'm sure some of it was mine due to normal everyday use, it would have been nothing different than my prior usage over the past 8 years.

The firm claims that they had "reason" to investigate my usage and I would have investigated it as well had this type of pornographic usage shown up on a server I was monitoring. However, if the IT folks flagged my account due solely to these false items, I never would've been suspected of any wrongdoing and my "normal" usage would not have been an issue.

I guess my question is this: The fact is that, as I stated above, some of the items are surely mine (I think I saw my bank's website in the stack of paperwork for example) but it wouldn't have been an issue to be concerned about without the pornography. How can I contest this termination or am I stuck because I'm in an at will status?

A wrongful termination does not mean one in which you were fired for something you didn't do. It means one in which you were fired for a reason that violates the law.

You are free to try to contest it internally using any method your company provides for. But legally, this is not a wrongful termination, even if possibly unfair, and the law is not going to force them to return you to work.

So...I guess my follow-up is this....

First, thanks for the reply.

I'm 99% certain that someone falsified my internet usage records and that is the direct reason for my termination. I have no way to prove otherwise so what should I do?

Since I have no idea what grievance procedures your employer may or may not provide I can't tell you that.
