What is the name of your state (only U.S. law)? Indiana My husband was told to "resign" after 18 years and a woman that the boss had (and may still have) a sexual relationship with was hired in his place, can we sue?

Your husband's case will depend on why he was asked to resign. Contact a lawyer and bring any proof of your allegations.

Sorrry, not trying to be funny, but sad but true and very not fair, but even after eighteen years of hard work and good service, an employer can fire anyone at any time for any reason as long as it is not a reason that violates EEOC regs, such as sex, age, religion, race, etc.

Your husband needs to file at once for his unemployment insurance, tell them he was forced to resign, through no fault of his own, because the boss wanted to replace him with someone else. He does not have to have a separation notice or letter from the company to file, he needs to go on and file as soon as possible.

In most states, he will need to file through the telephone system or in person if that is an option instead of on the internet, since this probably will not be a simple lack of work claim.

The boss may lie and try to come up with hundreds of other reasons why he fired your husband, or he may simply say that your husband voluntarily resigned from the job. But you can protest this and your husband will be approved to receive weekly benefits, because he is out of work through no fault of his own. Hopefully, this jerk will not protest the unemployment claim, and your husband will soon find another better job.
