Our neighbor's house has been in a general state of disrepair since we bought our house 5 years ago. Over the past six months, we have noticed the ground surrounding the sewer drain on her property is constantly saturated and has begun to sink. We assume this indicates a leak in the pipe from her gutter drains to the sewer connection at the street. The constant saturation of the ground has caused our driveway to crumble and sink in the surrounding area.

What is the best way to proceed with repairs to our driveway? Should we file a claim with our homeowner's insurance and expect our insurance company to contact our neighbor for reimbursement? Should we contact our neighbor or her insurance carrier directly and request reimbursement?

How do we force our neighbor to repair the defects on her property that are causing this problem? If we repair our driveway and she does not repair her drainage system, we will have the same problem again in the near future. Our neighbor has consistently neglected her property and has been contacted numerous times by the City Building Department for housing code violations that she has failed to repair. It is unlikely that she will make the needed repairs simply by our request. What recourse do we have?
