HELP we need urgent advice !!!

My family owns a condo. About a month ago the washer leaked in the middle of the night and flooded both my family and the neighbor’s condo below us. Right away we tried to contact our building manager, and we couldn’t get a hold of him either by phone or in person. We had no way of knowing who to contact to help us prevent any further damages. We were contacted 48 hours later.

We immediately started taking out our carpets and rented a commercial grade dryer to use in our condo. No action was taken in the unit bellow us for another two days. On a sunday a damage repair company that was sent from the neighbor's insurance company to take care of the unit. Instead of trying to dry the water the workers started tearing down the walls and ceiling of our neighbor's unit.

When my family purchased the condo 8 years ago, no one told us that the homeowner dues that we pay each month do not include insurance, which would cover any damages to our unit. At the time of the accident my family didn’t have insurance covering the unit. We are now told that we have to pay 10,000 dollars for the repair of both units.

My mother lost her job and our income is not enough to cover the damages or to pay a lawyer. We think that we are not being treated rightfully and we need advice on how to proceed. We received a letter asking for 10,000 dollars by the 7/17/09.

The following clauses have been quoted to us many times but we don’t understand what they mean and how we can protect ourselves.

If I were the owner of that other unit, I'd be suing the heck out of who ever owns that condo of yours... had anyone read the CC&R's, you would have found out what you were responsible for vs. what the community is responsible for. That you didn't know and your ignorance has inconvenienced your neighbor is not their problem.

other than that, the only advice I have for you is to make sure your mother hires a good attorney. She'll need it.
