insurance subrogation


What is the name of your state (only U.S. law)? WA

So about a month ago, I flooded our townhouse kitchen. Later that afternoon I got a call from our HOA saying that water has leaked onto the unit below us. From what we understood, her insurance was going to cover her damages. But we got a letter from her insurance yesterday, saying they are doing a subrogation, and they want us to pay for the damages.

Now, my boyfriend is the one that sign for the townhouse lease. They are going after him for the money. However, I am the one responsible for it, is there anyway they could come after me instead? Also, is there anything I can do at this point? Negotiate to lower the amount? Set up payment plans?

Your boyfriend is responsible to the damaged party. You are responsible to him.

As for the rest...communication is key. How would WE know if they'd accept a payment plan?

Not having renters insurance is monumentally stupid.

Lawsuits are not about justice. They are about MONEY. If you don't want money, then you shouldn't be thinking about suing. And people post here because they are thinking about suing. Because they want money, no matter how much they don't want to admit that to themselves.
