Odd Liabiliaty Question


What is the name of your state (only U.S. law)? Missouri

If A buys a camper trailer (not mobile home) and titles jointly with B (not married). That is Owner A and B, address.... They were not married or related.

A, having more room stores the trailer at his home. During the course of ownership, the trailer is stolen. Naturally A is a homeowner and has homeowners insurance. B however, while not storing the trailer is also a homeowner and as such has homeowners insurance also.

My question is: who's insurance would be liable for the loss of the trailer?

This is a real life story and there is no ending yet!

Uh the TRAILERS insurance would cover the loss to the trailer.

The trailer should be listed on a auto policy as a rider. Because it is a trailer that moves by vehicle, the vehicles insurance would cover it.

Cant be simpler then that.

And a stolen trailer has nothing to do with liability as your title suggests, it has to do with the comprehensive coverage on the "vehicle" itself.

This trailer should have been covered. if it was not, then it is not covered. <-period.

Background Mistake


missouri.

Sorry if I neglected a fact. (as I get older, I forget more and more) The challenge is that neither owner had insurance specifallcy on the trailer. Apparently, there was inclusion in the homeowners' insurance for the loss, but it is not a separate rider. I do know A should have properly insured the trailer with its own policy, but it did not happen.

If both parties have insurance which will cover the same loss, then usually each policy will pay 50%.

I am interested in knowing what was the provision in the homeowners policy that would cover loss. Was it "off prem theft"?

Each homeowner policy would pay 50%, if it is covered, which I doubt. Trailers, motorcycles, atv's, mobil homes, rv's all need to be covered seperately with auto policys. And if stolen from a home, even with "Off Premisis theft coverage", it is not covered.

Note that I didn't comment on whether this particular loss IS covered, since I haven't read the policy, I'm just going off OP's assertion that coverage is available

Some Clarification


Actually, A did not buy a separate policy as his recommended by his agent, but his "deluxe" policy covered him for this kind of loss up to $2000.00. B also did not have a separate policy but has the same "deluxe" policy fro m the same company, but not agent. I don know if you can mention a specific insurance company, but all of my 20 plus years, house, boats, cars, motorcycles coverage has always been first class. On the few occasions that I have had claims, they were fair, fast and most importantly, treated me with respect.

This question was asked a couple months ago by this person. She seems to be trying to get the widow of A to file a claim for a trailer that she owned with the A. A is now deceased. Back then she was trying to find out if A's wife had any claim to the trailer since it was jointly purchased by A & B prior to A getting married to C.
