Illinois. We share an easement road for 4 other houses and the easement road is still owned by the landowner who split off the parcels. There is no homeowners association or no road association spelling out who maintains the road, no signs i.e. residents only other agreements - we simply have the easement language on our deeds. There is a lot of traffic on the road by non residents, ATVs and so on. The question is, if someone gets hurt on the road, who is liable, the road owner, the people with official easement rights maintaining the road or both? Also would a typical home owners policy cover such a situation? I'm getting different answers from different people including my insurance carrier. should some type of road association be formed in this situation? Thanks. Illinois
