Swimming Pool Collapsing

Hello, I'm in a huge dilemma. Last week my swimming pool collapsed and is now damaging the structure of my house. Due to this winter's strange climate with the hot warm and cold weather, my swimming pool had completely collapsed causing a mudslide in my backyard. The mudslides have caused the pool to push up against my house, which I'm afraid will cause damage to the house. My basement is completely damaged due to the flooding from the pool. I called up my insurance company and it took them over a week to visit the house and I was told that it is not covered under my policy because the damage was caused by a tree or some external factor. I do believe that the weather has caused this to occur and my insurance company refuses to do anything. Any suggestions would be appreciated. Contractors price the damage at over 32,000 to rebuild everything..

Was this an above ground or in ground pool, how old and was it under warrenty?
Did you try punping out the water with a sump pump?
