    Question A-2 Visa status and working without work permit

    What is the name of your state? Maryland
    My husband is applying for a change of status - A-2 visa (diplomatic status) to permanent resident (green card).

    He has legal status in this country only he can't work because of an agreement between the US and Indonesia. He is married to an American citizen. We have a 2 year-old son. He has been working without an authorized work permit for a couple of years. He pays income taxes on his salary and files tax returns every year. His employer never asked about his status.

    Our concern is that he might be denied permanent residency because he has been working illegally. Is this a valid concern? What, if any, are the consquences for working illgeally? Please advise.

    There could be a problem here because he worked for the past few years without authorization. If he filed taxes on this work, the IRS might be able to communicate with the BCIS. And according to your post, he can't work because of agreements between the two countries regarding his particular situation.
    Why would he file for and pay taxes for work that he knew was illegal? Here might be an answer to your question:

    "Be sure you do not begin employment until you have received authorization.
    Under no circumstances should you work past the expiration date of the employment authorization. Any work without authorization is a serious violation of immigration law. Working without authorization subjects you to arrest and deportation."
