I would like to know about Cancellation of Removal--how long it takes to get a hearing once the papers are filed, when do you file for EAD, if waiting for a visa is involved, and if someone has a real solid case for "exceptional and extremely unusual hardship" to their US Citizen spouse, parent, or child, approximately how long does it take to get a green card after the judge makes a favorable decision? I know these cases are relatively rare, but I would like to gather some facts before I make a decision, because this process essentially involves volunteering for deportation when USBCIS doesn't even know you exist. I have looked at form EOIR-42B and am thinking about consulting an attorney. I need to find one who is familiar with the process.
I've recently heard that even if a person qualifies, they only allow 4,000 per year. This case involves a USC child who has severe medical needs. Will they grant a stay of deportation if the quota is full? If there is a chance of deportation, it is too risky.
