Question

Citizenship Through Parents


As written on the USCIS website.

Individuals who were age 18 or older on February 27, 2001, do not qualify for citizenship under section 320 of the INA as amended by the CCA. To read the CCA, see the “Child Citizenship Act” link to the right. A person who was over the age of 18 on February 27, 2001, may, however, be a citizen under the law in effect prior to the enactment of the CCA. If you believe this may apply to you, please see the “Contact Us” link to the right to call our National Customer Service Center.

I was born in the Philippines, and came to the USA at the age of 6. Does the Citizenship through Parent apply to me, PRIOR to the February 27, 2009 Enactment of the CCA? And does INA Section 320 mean that the parent had to be a citizen at the time of the childs birth?

I have contacted the National Customer Service Center and all they kept reiterating was "you were over the age of 18 on February 27, 2001." No one was able to answer my question about prior to the CCA enactment.

What is the name of your state (only U.S. law)? California

If you were 18 before 2001, it means stop reading the CCA. You have to find out if you qualify for citizenship. You can achieve citizenship through your parents before that, the CCA primarily deals with adopted and those born out of wedlock.

What was the US citizenship status of your parents at the time of your birth?
Where were you born.

Why do you think you might be a citizen? You haven't said anything beyond you came to the US at age 6.
How did you get here, what status did you have and when did you have a US citizen parent.?
