deported person wants divorce

A relative of mine lived in CT with a student visa. Due to tuition, he stopped going to school and obtain a full-time job. He married and after three months of marriage he was arrested for deportation. He spent 4 months in a holding and since then has been out of the country for 19 months. Since he and his wife have separated for almost 2 years and he wants to get out of the marriage, he wants to annul his marriage. He does hope to come back to America, but since he has been away for so long, he became hopeless and decided to move on with his life; he is now hoping to start a life with someone else.

His wife will not do the paperwork needed since she does not want a divorce or annulment.

How can he get an annulment or divorce for his marriage in America?

Thank you very much for any suggestions you may have.

From you user name I infer that you are Greek or related to Greece. Your friend has the option to file for divorce in a Greek court. His x-wife can get served the papers via the US embassy. Your friend will ask that the Greek court has exclusive jurisdiction in the mater and his x-wife would have to argue her case in a Greek court. Should she fail to he can ask for a judgment by default. The decision of the Greek court is binding in the US as well. Should your friend not be Greek the same process would most like be applicable in many other countries.
