What is the name of your state? Georgia

I recently got married to a US Citizen, my husband began filing the necessary docs for me(I130,I485,I865,etc.) my 4yr. old is with me in the US we both originally entered the country on a B1 visa, his I94 has expired and we have not started filing for him as yet, how will an expired I 94 affect the filing process for him, as we don't intend to start filing for him for another month or two?What is the name of your state?

If your child's I-94 has expired but your husband will be submitting a petition on his behalf as his child, then it should not have any consequences to the immigration process that the I-94 is expired at the time of filing.
