Green Card while on CPT?Hi everyone, Any advice will be helpful. So I am a student on F1 visa. Got my bachelors in nursing from here in Wisconsin. Cleared the NCLEX (Nursing Licence Exam). I wouldnt qualify for a H1 visa...so I started school again. Now i am doing my Masters of science in nursing. I just started in june 2009. I am currently working full time at a hospital on CPT. My grades r fine, work is going ok, I will get CPT renewed for another 6 months when it expires in FEB 2010. My question is can my employer file for a green card? What other options do i have? I am tired of school. lol and working full time with full time school to maintain my f1 status isnt easy. So any sort of input or advice will be appreciated. any questions for me....pls feel free to ask. Thanks.What is the name of your state (only U.S. law)? |

| There are no special processing for GC for you at this time based on your occupation. Your employer needs to apply for H1B while there are still 2010 slots. You need to look at the USCIS website for a better understanding of the GC procedure. You seem to think that it is automatic and fast once the application is made on your behalf; this is not the case. |

| I know that man..but see if you are a RN you don't qualify for H1 visa. See one of the requirements for H1 is that the seat or job you are applying for should "require" a bachelors degree. Since one can become a RN after 2 year diploma or 4 year degree a floor nurse position doesnt qualify for a H1 visa. |Most of the job postings for a RN will say: Current RN licence required and BSN preferred. (not required). So there is no point in talking my employer to file for a H1 visa because I don't qualify for one. Since I am planning to work for my current employer through out my masters which will end in dec 2011 or may 2012...wouldn't it make sense to have my employer file for a GC? Only if I would qualify for a H1 Visa things would have been so much easier..... :-( Last edited by gseehra; 10-22-2009 at 12:45 PM. |

| Some nursing positions require BSNs which you state you have. Google "Nurse H-1b" and read the information on the Murthy website. |

| The employer can start the EB green card processing but you still have to remain in F-1 status and maintain that status since it is going to take a long time to get the permanent residence status through the employer even though nursing is a Schedule A occupation since the visa numbers are retrogressed.
