H1 Transfer

What is the name of your state (only U.S. law)? NJ

Hi,
I was on H4 visa and recently I have received H1 Approval from 1st Oct 09. My status change application from H4 to H1 is not submitted. My employer is unable to get me a project hence, I don't have pay stubs.

Am I eligible to transfer my H1 and join another company?

"Transfer" implies that you are able to begin work upon the receipt of the petition ny the USCIS. Since you are not currently in H1B status, it does not apply in your case.

Your new employer may file a petiton, but you are not allowed to work until you receive an approval notice and an I-94 placing you in H-1B status either as a COS from H4 or by stamping and entry into the US with that stamping.

There are no shortcuts to joining the new employer to avoid waiting on the petition approval in your situation.
