Hello Lana,

I came to US in 2002 on H1B from Employer A and went back to my home country. The H1B got expired in 2004 December. Now I am in US again on L1B from Employer B. Since I am already counted again the quota in 2002, Is it possible for Employer A to file again for me the New H1B using 2002, I-797 and EAC number.

Yes, it should be possible to convert to H-1B from the L-1 although you are only going to have very little time left since the H and L time count together toward the maximum amount of time you can spend in the US in that status (H or L)

I went back to home country in 2003 April. I came to US again in April 2005 from Employer B. So there are two years I was outside US. Right now I am on L1 from Employer B. My expired H1B was on Employer A. Now is it possible for Employer A to file for new H1B using 2002 EAC number and I-797.
