Dear All
I am out side USA.
My H1B petition has been approved by company A for the 2005.
That means i am within the quota cap of 2005.


But now i have a much better offer from another company B.
Company B would have filed a new petition for me , but now the quota is finished.
Is there any way i can join company B now ???
( I mean since i am already in the quota through company A , now if my company B files a H1B petition for me , will it be rejected or will it be approved ?)

Can i some how transfer my 'within quota' status to the new company B.

I want to avoid the below mentioned way....
One way would be to get my stamping done through company A
and work for 2 months and then join company B on H1B transfer

You may be able to get a new petition approved although it is not 100% clear how it would be counted since you do not yet have an actual visa granted to you and, therefore, you are not IN H-1B status.
