Illegal alien and divorcing in florida

What is the name of your state? Florida


For the sake of anonimity I'll just say that Jane, a dear friend, is in a rut. She has been in Florida illegally for over a decade and she decided to marry an *******. He is moving to another state and says that if she doesn't move with him he will sell the house, take all the money, and call immigration on her. She has two children, one legal, that she supports and she fears being deported because if she does...she's screwed. What legal rights does she have?
More importantly, can he really take all the house money [which is also in her name] and deport her? What can she do to fight it?:confused:

What kind of marriage is that???? Why the heck did she marry him if she doesn't want to move with him?

2 Childeren, one legal, what do you mean? One was born in the US???

She has no legal rights when it comes to this situation immigration wise - she is here illegally, that's a crime, and she should take her children (granted none are his' or any other American man's) and go back to her homecountry.

She married a what??
What do you mean she's been here illegally for a decade, did she enter illegally or did she overstay a visa?
If she entered illegally, she cannot become legal. If she entered legally, but her marriage has fallen apart, she has no basis for a green card application. Doesn't look good for her either way.

Post here herself, so she can answer to 1001 questions required to even figure out what is possible for her.
Her situation is not simple. she needs her own lawyer, but she should not expect to be able to stay in the US if she has not applied for any benefits from Immigration.
